Affiliate Program Terms

1. Who we are and who you are

The Program is operated by: Promo Lab s.r.o., Střední 370, 250 64 Hovorčovice, Business ID: 74162284. Contact: info@inmyresume.com.

“We” and “us” mean the operator. “You” and “partner” mean the person or company taking part in the Program. You act as an independent contractor: the Program creates no employment, agency, partnership or joint venture, and you may not act or sign on our behalf.

2. Joining the Program

• You need an InMyResume account and must be at least 18 years old and able to enter into contracts.
• Each person or company may hold one partner account. Accounts cannot be transferred.
• You join on the affiliate page of your account by accepting these Affiliate Terms. We may refuse or end a participation without giving reasons, in particular where we suspect a breach of section 8.

3. Your link and how referrals are counted

You get a personal link containing your code (?ref=your-code). You may add it to any page of our website, and you may add a source tag (&src=…) to see in your statistics which placement a click came from.

• If the visitor accepts cookies, a click on your link is remembered in their browser for 60 days. Without that consent we do not store it, as the law requires, and the visit cannot be credited to you. If the visitor later clicks another partner’s link, the most recent click counts.
• When a visitor who clicked your link signs in to an account or pays, that account is linked to you permanently. Its later purchases and subscription renewals are credited to you as well, even without a new click. An account already linked to another partner stays with that partner.
• Our payment provider Lemon Squeezy also runs an affiliate program for our products, with its own partners and links (?aff=…). One order is credited to one program only: the one whose link the buyer clicked last. If a buyer linked to you clicks a Lemon Squeezy partner’s link after your last click and then pays, that order, and the renewals of a subscription it starts, are credited to the Lemon Squeezy partner and not to you. The account stays linked to you for its other purchases.
• A referral is counted only when the visitor’s browser keeps our cookie. Declined or blocked cookies, private browsing or a different device can prevent a referral from being recorded; we cannot credit referrals we have no record of.
• Clicks are counted in your statistics at most 20 times per visitor and day. Statistics are for your information; commissions depend only on paid orders.
• Our records are decisive for which referrals and payments are credited to you. If you believe something is missing, write to us within 60 days of the payment.

4. Commission

You earn 50 % of every paid order credited to you under section 3. The commission is calculated from the amount the customer actually paid, after discounts and without VAT or sales tax, as reported by our payment provider Lemon Squeezy, in US dollars.

• This covers all our paid products: one-time purchases (e.g. PDF exports and the Job Search Pack), the first payment of a subscription and its renewals.
• No commission is paid on: your own purchases or those of your own accounts; orders that are refunded, charged back or cancelled; payments obtained in breach of section 8; free plans, trials and fully discounted orders.
• A commission becomes final only after the hold period in section 5. If an order is refunded or charged back during it, its commission is cancelled, or reduced in proportion to a partial refund.
• If an order is refunded after its commission was paid out, the commission (or its refunded share) is deducted from your next payout. It is shown on your affiliate page and on the payout statement. We do not ask you to pay it back separately unless your membership ends with a negative balance.

5. Hold period and payouts

• Every commission is held for 30 days after the payment, to cover our refund period. After that it is ready for payout.
• We pay out once your ready balance reaches $20, normally within the first 15 days of each calendar month. A balance below that amount rolls over to the next month.
• Payouts are made in US dollars by PayPal, Wise or bank transfer, to the account you enter in your payout details. We bear the sending fees of the method you choose; fees charged by your own bank or provider, and any currency conversion, are yours.
• We pay only after you have accepted the current version of these Affiliate Terms and entered complete payout details (section 6). Until then your commissions keep accruing and are paid with the first payout after you complete them.
• With each payout we send you a payout statement by e-mail. It is also available on your affiliate page and lists its number, date, amount, method and every commission and deduction it covers.
• A payout sent to the account details you entered is final. We are not responsible for losses caused by incorrect details you provided.

6. Information you must provide for payouts

Before your first payout you must enter the following in the payout details on your affiliate page, and keep them up to date:

• Who you are: whether you take part as an individual or as a business, and your full legal name, or the registered company name.
• Your address: street, city, postal code and country. The country is taken as your country of tax residence.
• For a business: your company registration number (in the Czech Republic, IČO) and, if you are registered for VAT, your VAT number.
• Where the money goes: the e-mail address of your PayPal or Wise account, or, for a bank transfer, the IBAN and the BIC/SWIFT code of an account held in your name or your company’s name.

We may ask for documents that confirm your identity, address or bank account, or for additional information required by tax or anti-money-laundering rules, and we may hold payouts until we receive them.

7. Taxes and invoices

• Commissions are paid as gross amounts. You are solely responsible for declaring them as income and for paying any income tax, social security, health insurance and other charges in your country.
• Promo Lab s.r.o. is not a VAT payer; it is registered in the Czech Republic as an identified person for VAT.
• If you take part as a business, the payout statement we send you with each payout serves as the basis for your invoice. We may withhold a payout until we receive a required invoice.
• If you are registered for VAT in another EU member state, invoice the payout without VAT with the note “reverse charge” and our VAT number; we account for the VAT in the Czech Republic.
• If you are a VAT payer in the Czech Republic, the commission includes the VAT you charge on it: the amount on your invoice, VAT included, equals the payout.
• If the law requires us to withhold tax from a payout, we will do so and tell you.

8. How you may promote us

You may share your link on your own website, blog, social media, newsletter, videos and in direct recommendations to people you know, using the banners and texts we provide or your own honest content. You must always make clear that you earn a commission, for example with “affiliate link” or “#ad”, as consumer protection rules require.

You must not:

• send unsolicited messages (spam) by e-mail, SMS, messengers or comments, or buy e-mail lists;
• bid on the InMyResume name, its misspellings or our domain in paid search or social ads, or run ads that link straight to our website without our written consent;
• pretend to be InMyResume, create websites, profiles or apps that could be mistaken for ours, or use our name in your domain or account names;
• make false or misleading statements about our products, prices, discounts or results (for example guaranteed jobs), or publish discount codes that do not exist;
• set cookies or open our website without a real click by the visitor (cookie stuffing, hidden frames, pop-unders), use bots or generate fake traffic, sign-ups or purchases;
• offer cash back, rewards or part of your commission to people for using your link, or buy through your own link;
• promote us next to illegal, hateful, violent, sexually explicit or otherwise harmful content.

If you breach this section, we may cancel commissions earned through the breach, suspend payouts and end your participation with immediate effect.

9. Banners and our brand

For as long as you take part in the Program, we grant you a non-exclusive, non-transferable, revocable licence to use the InMyResume name, logo, banners and texts from your affiliate page, solely to promote us under these Affiliate Terms. You may not alter the logo or banners apart from resizing them proportionally. When your participation ends, remove them within 14 days.

10. Personal data

We process your account, payout and tax details to run the Program, pay commissions and meet our accounting and tax obligations, as described in our Privacy Policy. Payout and tax records are kept for as long as accounting and tax laws require.

You see only aggregated statistics about your referrals: clicks, sign-ups, paid orders and amounts. We never share the identity of the customers you refer with you.

11. Ending your participation

• You may leave the Program at any time with the “Leave the program” button on your affiliate page, or by writing to info@inmyresume.com. We confirm it by e-mail.
• We may end the Program or your participation at any time with 14 days’ notice by e-mail, or with immediate effect if you breach these Affiliate Terms.
• After your participation ends, commissions earned before it ended are paid out after their hold period, even below $20, unless they were earned in breach of these Affiliate Terms. No commissions are earned after the end date.

12. Liability

We provide the Program as it is and do not guarantee any level of earnings. We are not liable for lost commissions caused by technical outages, blocked cookies or errors of third-party services, except where we acted intentionally or with gross negligence. Our total liability to you is limited to the commissions paid or payable to you in the 12 months before the claim.

You are responsible for your promotion and its compliance with the law, and you will compensate us for any claims, fines or costs caused by your breach of these Affiliate Terms.

13. Changes and governing law

We may change these Affiliate Terms. We will tell you about changes by e-mail and on your affiliate page at least 14 days before they take effect. If you do not agree, you may leave the Program before then; commissions earned until then will be paid under the previous terms. Once the new version is in effect, payouts wait until you accept it.

When you join, we e-mail you a confirmation with the version of these Affiliate Terms you accepted. Earlier versions are available from us on request.

These Affiliate Terms are governed by the laws of the Czech Republic. Disputes will be decided by the competent courts of the Czech Republic, unless mandatory law gives you the right to go to court in your own country. Questions: info@inmyresume.com.
